Estate, Probate and Trust Administration

Our firm has extensive experience representing personal representatives, trustees, and beneficiaries in handling estate and trust administration matters.  We assist clients with the estate and probate process, including gathering assets and ensuring that after taxes and expenses are paid, those assets pass to the heirs or beneficiaries of an estate.

We prepare all documents required in connection with estate and trust administration, including petitions and applications for probate, inventories, accountings, and asset transfer documents. We prepare and file federal estate tax returns (IRS Form 706). Our attorneys advise personal representatives on tax elections, marital and charitable deduction issues, disclaimers, and estate and generation-skipping transfer taxes. We regularly counsel individual and corporate trustees on various aspects of trust administration, including income and principal allocation and apportionment issues, legal requirements relating to trust investments, discretionary distribution decisions, and the selection, resignation and removal of trustees.
